Understanding separation
Separation occurs when one or both parties decide that the relationship has ended. The Family Law Act 1975 (Cth) does not require formal documents for separation. The law only requires that at least one party has formed the view that the relationship is at an end.
Separation can occur while both parties continue to live in the same home. This is known as separation under one roof. If this applies to you the court may require evidence of the separation when you apply for divorce. Evidence may include statements confirming separate lives, financial independence or changes in daily routines.
Understanding divorce
Divorce is the legal end of a marriage. The Federal Circuit and Family Court of Australia deals with divorce applications. Australia has a no fault system. The only ground for divorce is that the marriage has broken down irretrievably. To prove this the parties must have been separated for at least twelve months.
If you have children under eighteen the court must be satisfied that proper arrangements are in place for their care. The court does not need perfect arrangements. The court only needs to be satisfied the children are safe and supported.
A divorce does not determine parenting or property issues. Those issues must be handled separately. Time limits apply. Property and spousal maintenance applications must be filed within twelve months of the divorce becoming final. This time limit is set out in s 44(3) of the Family Law Act 1975 (Cth).
